Terms of Use

The following are the Terms of Use of the COLFIRE website, mobile application and/or other COLFIRE online service or application (“the Web-Services”). You are granted a non-exclusive, non-sublicensable, non-transferable, personal, limited license to install and use the Web-Services only on a mobile device that you own or control, solely as expressly permitted herein. Your use of the Web-Services is subject to your acceptance and compliance with these Terms of Use. By downloading, installing or using the Web-Services or accessing any content provided by it, you acknowledge your assent to the following terms of use without limitation or qualification. Please read them carefully. If you do not agree with these Terms of Use, you should not download, install or use the Web-Services.

1. The Web-Services is operated by COLFIRE, a duly registered general insurance company operating within Trinidad and Tobago. We refer to ourselves as “we” “us” and “our.”

2. We reserve the right to change these Terms of Use at any time without notice to you by updating the Web-Services to incorporate the new terms of use. You are responsible for regularly reviewing these Terms of Use to obtain timely notice of such changes. Your continued use of the Web-Services after changes are posted constitutes your acceptance of the Terms of Use, as may be amended or varied from time to time.

3. We are offering you this Web-Services to use without cost, but you should be aware that you will need Internet connectivity and appropriate telecommunication links to use certain features or functions of the Web-Services. We accept no responsibility or liability for any telecommunication or other costs you may incur as a result of using the Web-Services.
    

4. You may generate content while using the Web-Services and in doing so, you assume sole responsibility for the creation of such content and its confidentiality.
    

5. Any information, other than personal data or information you transmit to COLFIRE via the Web-Services, by electronic mail or otherwise, including data, questions, comments, or suggestions, will be treated as non-confidential and non-proprietary and will become the property of COLFIRE. Such information, other than personal information, may be used for any purpose, including, but not limited to, reproduction, solicitations, disclosure, transmission, publication, broadcast, and posting. COLFIRE is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to COLFIRE via the Web-Services or by any other means for any purpose whatsoever, including, but not limited to, developing and marketing products using such information.
    

6. Regardless of whether you think your use of the Web-Services is for our benefit, the Web-Services may never be used:

   1. In a manner that is prohibited by any law, statute or regulation of any applicable jurisdiction;

   
   

   2. In connection with fraudulent, criminal or otherwise unlawful activity;

   
   

   3. To impersonate or otherwise misrepresent your identity or affiliation;

   
   

   4. To access accounts that you are not authorized to access;

   
   

   5. To invade the privacy of third parties, including consumers; o In a manner that infringes or misappropriates any patent, trade secret, copyright, trademark, or other proprietary rights of any third party;

   
   

   6. To violate, or facilitate or assist in violating, the security of the Web-Services, whether intentionally, negligently or otherwise; or

   
   

   7. To transmit by means of the Web-Services any data or material that contains software viruses or any other malicious code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

7. If you access nonpublic personal information of customers (“NPPI”) via the Web-Services, or generate content that includes NPPI while using the Web-Services, it is your sole responsibility to comply with applicable laws regarding the confidentiality and security of any NPPI stored on, or transmitted by, your device.
    

8. You are not allowed to copy or modify the Web-Services, or any part of the Web-Services, and you are not allowed to extricate, or attempt to extricate, the source code of the Web-Services. You may not translate the Web-Services into other languages or make derivative versions. Along those lines, except where otherwise indicated, all materials contained in the Web-Services, including but not limited to graphics, text, software, audio, video and files, are either the property of, or used with permission by, COLFIRE, and are protected by intellectual property laws. COLFIRE reserves all rights in these materials. If you are permitted to download material accessed via the Web-Services, you may not remove any copyright and other proprietary notices contained on the materials.

9. All trademarks, service marks, trade names, logos, and icons are proprietary to COLFIRE or used by COLFIRE with the permission of its third party providers. Nothing contained on the Web-Services should be construed as granting, by implication or otherwise, any license or right to use any COLFIRE trademark, service mark, trade name, logo, icon and domain name displayed on this website without the written permission of COLFIRE. All other trademark, service mark, trade name, logo, icon and domain on the Web-Services are the trademarks of their respective owners and you must not use such marks without their permission. Your use of the trademarks, service marks, trade names, logos, icons and domain names displayed on this website, except as provided herein, is strictly prohibited.

10. Except as otherwise expressly permitted by COLFIRE and/or the applicable third-party licensor, no materials presented in or provided by the Web-Services may be downloaded, copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. You may not distribute, modify, transmit, reuse, repost, or use the content provided by the Web-Services for public or commercial purposes, including any text, images, audio, and video, without COLFIRE’s and/or its third-party licensor’s prior written permission. We neither warrant nor represent that your use of materials provided by the Web-Services will not infringe rights of third parties.

11. You agree to defend, indemnify and hold harmless COLFIRE, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Web-Services, and any of the programs, materials or resources made available to you on the Web-Services; (ii) your violation of any term of these Terms of Use; or (iii) your violation of any third party proprietary right. This indemnification obligation will survive these Terms of Use and your use of the Web-Services.

12. Disclaimer of warranties. The Web-Services is provided on an "as is" and "as available" basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of uninterrupted or error free service, or implied warranties of non-infringement, merchantability, or fitness for a particular purpose. COLFIRE does not warrant or make any representations regarding the use or the results of the use, of the Web-Services or the materials provided by it in terms of their correctness, accuracy, reliability, or otherwise. The information and descriptions contained herein are not necessarily intended to be complete descriptions of all applicable terms, exclusions and conditions and are provided solely for general informational purposes. Please refer to the actual policy of insurance.

13. Disclaimer of liabilities. While we use reasonable efforts to include accurate and up-to-date information on the Web-Services, errors or omissions sometimes occur. You agree that COLFIRE shall not be liable for any direct, indirect, incidental, special, punitive, consequential or exemplary damages arising out of or in any way related to the use of, or inability to use, the Web-Services, including without limitation, damages for loss of profits, use of data or other intangible losses (even if we have been advised of the possibility of such damages). In no event shall COLFIRE’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for the Web-Services.

14. The Web-Services is provided for your convenience. If there is any discrepancy between information presented in the Web-Services and our internal system records, the internal system records will be considered authoritative and controlling.

15. We do not warrant that the Web-Services will operate error free or is free from viruses, worms, Trojan horses or other destructive or harmful code. We also assume no responsibility, and shall not be liable for, any damages to your computer equipment, mobile device or other property as a result of your access to, use of, the Web-Services or your downloading of any materials, data, text, images, video, or audio from this App or arising in connection with any failure of performance, error, omission, interruption, defect, computer virus, delay in operation or transmission, or line or system failure.

16. We may make services available through the Web-Services that are provided by a third party. We cannot and do not take responsibility for third party services.

17. For your convenience, the Web-Services may contain links to other websites. The inclusion of any links to such websites does not imply our approval of or endorsement of those websites, their content or their products and services. We cannot guarantee that the links set out in the Web-Services will be accurate at the time of your access. Moreover, the sites pointed at by links have been independently developed and possibly maintained by person(s) over whom we have no control. We are not responsible for the content of these websites, or problems you may encounter at other sites. These websites may also have their own terms and conditions, which you may be subject to. We believe that our making available links to publicly accessible web pages is legally permissible and consistent with the common, customary expectations of those who make use of the Internet.

18. We may collect information about your use of the Web-Services when you use it. This information helps us to better understand how the Web-Services is being used and what we can do to make it more useful to users. 

19. These Terms of Use and all other aspects of your use of the Web-Services shall be governed by and construed in accordance with the laws of Trinidad and Tobago.

20. The failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
